In a lawsuit filed last Wednesday, Adidas is suing THQ for “breach of contract” and seeking up to $10 million-dollars in damages. Adidas is claiming that the game publisher did not provide the “micoach” software by the agreed on deadline.
This according to The Oregonian, who claims that THQ was initially set to create the “micoach” software for Adidas but failed to meet the January deadline. The software is simular to the “Nike+” software that is already available. This software allows people to keep track of exercise routines, including distance ran, time spent exercising and other factors. The original project was set in motion back in December 2011.
This comes at a time when THQ has suffered massive layoffs (over 240 so far) and a rising debt. Nasdaq even threatened to remove THQ from their listings. The Oregonian states that THQ warned Adidas that it would not finish the project, as the development team working on the software was affected by the previously mentioned layoffs.
THQ has refused to comment on the situation so far, currently Adidas is requesting an injunction to prevent THQ from selling or transferring the rights to any micoach related media.
